This course provides a basic introduction to trademark law in the United States, as well as instruction in specific topics in trademark law that may be of particular interest to practitioners from outside the U.S. Topics covered include: an overview of U.S. trademark law, non-traditional marks and the doctrine of functionality, trademark use as the basis for priority under U.S. law, the significance of and procedures for U.S. trademark registration, the protection of foreign marks under U.S. law, forms of trademark liability, defenses to trademark claims, remedies for trademark infringement, domain names, and secondary liability.
